These terms and conditions apply from August 1, 2024.

Legal liability

The following conditions are recognized as binding between seller and buyer upon conclusion of the contract. Deviating agreements require the written consent of both parties. Seller is: Marlene Merle, Calle Dinamarca 3, 35508 Costa Teguise, Lanzarote, Spain; tax number NIF X2365645A; email: shop – at – semillas.de.

Pricing

All prices apply as published in the shop at the time of purchase and as stated in the order confirmation. There are no minimum order quantities. Shipping costs are as invoiced and include simple, cost-effective packaging.

Payment

Payment is made immediately after completing the purchase, using the payment methods specified in the shop. Only paid orders are considered completed and will be processed. In the event of non-payment, no purchase contract is concluded and there is no claim to the goods.

Sold out products

If a product that has been ordered and already paid for is no longer available, the buyer will be informed by the seller via email. The buyer can then decide within three working days whether the purchase price of the product should be refunded to him or whether a replacement product (same price, buyer’s choice) should be included in the shipment. If the buyer doesn’t respond to the seller after three working days, the amount will in any case be refunded and no replacement delivery will be made.

Warranty service

Semillas’ products are valued for their high quality, for being true to type and providing above-average germination rates. Under ideal conditions, you should achieve a germination rate of 90% or more with seeds from Semillas. Since the germination process is influenced by multiple factors in your own culture, and this is not accompanied and secured by Semillas, the purchase of the seeds isn’t linked to any guarantee of success in cultivation. Undeliverable goods

If goods can’t be delivered and are lost due to the buyer’s incorrect or incomplete address, there’s no right to replacement or refund of the purchase price. Even if the item is returned to the sender by the postal service, this claim doesn’t apply, as returns to the Canary Islands usually take several months. Since the seeds are exposed to various weather conditions during this time, they’re then worthless and can’t be sold. When entering your address details in the online form, make sure that they’re entered correctly and completely. When shipping to a business address, it’s important to include the name of the company and, if applicable, the relevant department to ensure delivery. Semillas always recommends shipping to a private address where the buyer resides and has a mailbox labeled with his or her own name, and to which the goods can be delivered at any time of the day.

Right of withdrawal and right of return

In accordance with applicable European law, Semillas grants a 14-day right of withdrawal. The revocation doesn’t require any justification and must be sent by email to shop – at – semillas.de. A simple cancellation is no longer possible if the goods are already on their way to the buyer. The goods must then be returned to Semillas upon receipt by the buyer and at their own expense (see address at the top of this imprint). The purchase price will only be refunded if the goods are complete, still in their original packaging and undamaged.
